By browsing and using this website the client agrees to comply with and be bound by the following Terms and Conditions of use, which together with Findmedrivers.co.za Privacy Policy and Third Parties & Other Users Policy, govern the relationship between Findmedrivers.co.za and the client in respect of the client’s use of our website.
1. DEFINITIONS AND INTERPRETATION
1.1 “Findmedrivers.co.za”, “us” “our” or “we” refers to the owner of this website, whose registered office is in South Africa.
1.2 “Client”, you”, “your” and “user” as used herein refer to the user or viewer of this website.
1.3 “Website” means the Findmedrivers.co.za website, www.findmedrivers.co.za, including any part or element thereof.
1.4 “Database” refers to the all Findmedrivers.co.za Databases.
1.5 “Content” means any work of authorship or information, including salaries, company reviews, interview reviews, comments, opinions, postings, messages, text, files, images, photos, works of authorship, e-mail, or other materials on the Findmedrivers.co.za website, www.findmedrivers.co.za, including any part or element thereof.
1.6 “Services” means all products and/or services offered on the Findmedrivers.co.za website, www.findmedrivers.co.za, including any part or element thereof.
1.7 References herein to the singular includes the plural and vice versa.
2. GRANTING OF LICENSE
2.1 Findmedrivers.co.za grants the client a license to access and use the Findmedrivers.co.za services on our website at www.findmedrivers.co.za at any time and their account is in good standing.
2.2 The use of the license by the client who is a business is restricted to the authorized personnel of the client’s business, or in the respect of an individual, to the individual.
2.3 The Agreement and the license and rights it grants to the client may not be ceded, assigned, leased, rented, sub licensed or otherwise transferred by the client to a third party, without the prior written authority of Findmedrivers.co.za.
3. Findmedrivers.co.za SERVICES
The license entitles the client to:
3.1 Access to the Findmedrivers.co.za Website Application for users as outlined in Clause 2.
3.2 Post an unlimited number of job related advertisements on a business profiled advertisements page which will be reflected on Findmedrivers.co.za website as well as on Findmedrivers.co.za partner websites.
3.3 Receive applications and/or responses online and via email to the client’s chosen email address.
3.4 Dependant on the subscription package the client has selected, the client has access to unlimited CV searches however, a restriction of CV downloads will be in accordance with the Findmedrivers.co.za subscription package the client has selected.
3.5 Email support is available to all users from Findmedrivers.co.za from Monday to Friday between 09h00 and 16h00 on week days (excluding public holidays).
4. ACCESS TO AND USE OF SYSTEM AND WEBSITE
4.1 The client may not use the database for, or in connection with, any unlawful or unauthorized purpose.
4.2 The client may not use the database for any purpose other than what Findmedrivers.co.za was intended for which is for the client to assist jobseekers in finding legitimate job opportunities and to search the database for jobseekers that the client has a vacancy and/or legitimate job opportunity to offer the jobseeker.
4.3 The data obtained by the client from the system may not be disseminated in any form for any use by any third party.
4.4 Findmedrivers.co.za will provide the client with a facility to create its own password/s that enables the client to access the Findmedrivers.co.za Website Application.
4.5 The client agrees to keep its password/s confidential and not to allow any third party to have knowledge of or use of them.
4.6 The client acknowledges and agrees that Findmedrivers.co.za may implement technical measures that permit Findmedrivers.co.za to verify the client’s compliance with the terms of the Agreement.
4.7 The client’s right to access the system ends upon termination of the Agreement for any reason whatsoever.
4.8 The client undertakes to ensure that access rights for staff who leave its employ are immediately disabled through Findmedrivers.co.za support systems.
5. SUBSCRIPTION PERIODS AND FEES
5.1 Fees are payable in advance as per Findmedrivers.co.za plan offering as represented on our website as well as in the contract between the client and Findmedrivers.co.za.
5.2 Findmedrivers.co.za reserves the right to increase subscription fees.
6. PAYMENTS
6.1 The client is liable to pay the subscription fee applicable to the subscription period and subscription package chosen by the client.
6.2 Access to the system will only be granted if the client has registered and paid for a Standard or Professional Package.
6.3 All subscription fees paid by the client will not be refundable under any circumstances whatsoever.
6.4 The client understands that Findmedrivers.co.za may suspend or block access to the client’s Findmedrivers.co.za account if there are any outstanding and/or unpaid invoices.
6.5 Professional Account Holders agree to furnish Findmedrivers.co.za with the following documents:
a. Business Accounts: Certified copies of: Business Registration + Green Bar Coded ID Book or ID Card + Proof of Business Operations Address
b. Personal Accounts: Certified copies of: Green Bar Coded ID Book or ID Card + Proof of Residential Address
7. VISITOR CONDUCT
7.1 With the exception of personal information, the use of which is covered under Findmedrivers.co.za Privacy Policy, any material the client sends or posts to this website shall be considered non-proprietary and not confidential.
7.2 The client shall not use the website in order to post, transmit, distribute, store or destroy material:
(a) in violation of any applicable law or regulation;
(b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others or Findmedrivers.co.za;
(c) that is defamatory, obscene, threatening, abusive, racist or hateful etc…
7.3 The client is prohibited from violating or attempting to violate the security of this website, including, but without limitation:
(a) accessing data not intended for such user or logging into a server or account which you are not authorized to access;
(b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization;
(c) attempting to interfere with service to any user, host or network, including, without limitation, via means of submitting a virus to the website, overloading, “flooding”, “spamming”, “mailbombing” or “crashing”;
(d) sending unsolicited emails, including promotions and/or advertising of products or services to any persons on our database including but not limited to jobseekers;
(e) forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting;
(f) deleting or revising any material posted by any other person or entity;
(g) using any device, software or routine to interfere or attempt to interfere with the proper working of this website or any activity being conducted on this website.
7.4 Violations of paragraphs 7.2 or 7.3 may result in civil or criminal liability.
8. SYSTEM AND WEBSITE ACCESSIBILITY
8.1 The client shall not have any claims against Findmedrivers.co.za, nor shall be entitled to any reduction in subscription fees payable under the Agreement, in the event that the Findmedrivers.co.za system is not accessible as a result of:
8.1.1 Routine or planned maintenance;
8.1.2 Circumstances beyond the reasonable control of Findmedrivers.co.za (including without limitation, the failure of hosted network infrastructures and Internet Service Providers); and/or
8.1.3 Other downtime resulting in the system being unavailable, providing that such downtime (other than downtime resulting from the circumstances contemplated by clause 8.1.1 and 8.1.2 above) shall not exceed 60 hours per month.
8.2 For the purpose of this clause 8, downtime is measured from the time a fault is logged by the client (provided that the fault is verified by Findmedrivers.co.za as arising from the failure of the Findmedrivers.co.za server and/or supporting software), to the time that the system is once again accessible to and data is capable of being transmitted and received on the website by the client.
9. LINKS TO AND FROM OTHER WEBSITES
9.1 Any links to third party websites located on the Findmedrivers.co.za website are provided for the client’s convenience only. They do not signify that Findmedrivers.co.za endorses the website(s). Findmedrivers.co.za has no responsibility for the content of the linked website(s).
9.2 In the event the client would like to link to the Findmedrivers.co.za website, the client may only do so on the basis that the client links to, but does not replicate, any page on this website and the client does not in any way imply that Findmedrivers.co.za is endorsing any services or products unless this has been specifically agreed with Findmedrivers.co.za in writing.
9.3 If the client links to the Findmedrivers.co.za website in breach of the above, the client shall fully indemnify Findmedrivers.co.za for any loss or damage suffered as a result of the client’s actions.
10. MISCELLANEOUS
10.1 All time displayed on the website is GMT+02. This includes the Resume downloaded times.
10.2 IP addresses are tracked and recorded.
10.3 Every Resume the client downloads from the Findmedrivers.co.za database will display the IP address used for the download.
10.4 All account activity is electronically recorded.
10.5 Email support is available to all users from Findmedrivers.co.za from Monday to Friday between 09h00 and 16h00 on week days (excluding public holidays).
10.6 The Website is Java Script enabled. Please note that if Java is not up to date on your system or your browser does not support Ajax, certain elements on our website will not display correctly.
10.7 Pressing CTRL + F5 (refresh) should update your display screen with information live and directly from the server.
11. EARLY TERMINATION AND BREACH OF CONTRACT
11.1 Duration of all contracts: from date of signup for relevant subscription period that the client has chosen. In the event the client cancels/terminates and/or breaches the Agreement for whatsoever reason during the course of the subscription period, the Agreement will be cancelled immediately with and/or without further notice to the client.
11.2 Findmedrivers.co.za may request from or provide to any credit bureaux the client’s information on account registration and/or if the client fails to make payment of any outstanding monies owed to Findmedrivers.co.za.
11.3 In the event the client fails to comply with the provisions of clause 2 of the Agreement, Findmedrivers.co.za may immediately cancel this Agreement without further notice to the client and no refunds will be considered and/or issued under any circumstances whatsoever.
11.4 In the event the client registers an account with false, misleading and/or has mis-represented information with regards to their business operations and/or intentions, this shall constitute fraud and Findmedrivers.co.za may immediately cancel this Agreement without further notice and no refunds will be considered and/or issued under any circumstances whatsoever.
12. EXCLUSION OF LIABILITY
12.1 Findmedrivers.co.za takes all reasonable steps to ensure that the information on our website is correct. However, neither findmedrivers.co.za nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. The client acknowledges that such information and materials may contain inaccuracies or errors and Findmedrivers.co.za is expressly excluded from liability for any such inaccuracies or errors to the fullest extent permitted by law.
12.2 Findmedrivers.co.za is not to be considered a recruiter and/or employer with respect to the use of the website and shall not be responsible for the client entering into any Agreements and/or making decisions of whatever nature resulting from the posting of jobs, resumes and/or any other information obtained on the Findmedrivers.co.za website. The client’s use of any information or materials on the Findmedrivers.co.za website is entirely at its own risk, for which Findmedrivers.co.za shall not be liable. It shall be the client’s own responsibility to ensure that any products, services and/or information available through the Findmedrivers.co.za website meet its specific requirements.
12.3 In no event shall Findmedrivers.co.za, our suppliers, or any third parties referred to on the Findmedrivers.co.za website be liable for any damages of whatsoever nature, whether for bodily, moral or material injury (including, without limitation, indirect, punitive, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use the website and the material, whether based on warranty, contractual or extra-contractual liability, or any other legal matters, and whether or not Findmedrivers.co.za is advised of the possibility of such damages.
13. TERMINATION, SUSPENSION AND REMOVAL OF INFORMATION
13.1 Duration of all contracts: from date of signup for relevant subscription period that the client has chosen. In the event the client cancels/terminates and/or breaches the Agreement for whatsoever reason during the course of the subscription period, the Agreement will be cancelled immediately with and/or without further notice to the client.

13.3 In the event the client fails to comply with the provisions of clause 2 of the Agreement, Findmedrivers.co.za may immediately cancel this Agreement without further notice to the client and no refunds will be considered and/or issued under any circumstances whatsoever.
13.4 In the event the client registers an account with false, misleading and/or has mis-represented information with regards to their business operations and/or intentions, this shall constitute fraud and Findmedrivers.co.za may immediately cancel this Agreement without further notice and no refunds will be considered and/or issued under any circumstances whatsoever.
14. JURISDICTION
14.1 The client’s use of the Findmedrivers.co.za website and any dispute arising out of such use of the website is subject to the laws of South Africa.
14.2 Should any part of these Terms and Conditions be held by a court of competent jurisdiction to be unenforceable, the validity of the remainder of the Terms and Conditions shall not be affected.
